SC Rejects Challenge to Suresh Sallay’s Arrest
A Fundamental Rights petition filed by retired Air Force officer Shantha Jayathilaka, challenging the arrest and detention of former State Intelligence Service (SIS) Director Suresh Sallay under the Prevention of Terrorism Act (PTA) in connection with investigations into the Easter Sunday terror attacks, was dismissed by the Supreme Court today. The order was issued after the petitioner sought the court's permission to withdraw the petition. The petition was taken up before a bench comprising Chief Justice Preethi Padman Surasena and Justice Achala Wengappuli. When the matter was called today, Additional Solicitor General Sudarshana de Silva, appearing on behalf of the Attorney General, informed the court that preliminary objections would be raised against the petition. The Additional Solicitor General submitted that the petitioner lacked the necessary legal standing to maintain the application before court. Following the clarification of these matters, the petitioner requested permission from the court to withdraw the petition. After considering the submissions made, the Supreme Court bench granted permission for the petitioner to withdraw the application and ordered that the petition be dismissed without costs.
